User agrees that Company shall not be responsible or liable to user, or anyone, for the statements or conduct of any third party of the service. In sum, in no event shall Company's total liability to the User for all damages or/and losses or/and causes of action exceed the amount paid by the User to Company, if any, that is related to the cause of action.

DISCLAIMER OF CONSEQUENTIAL DAMAGES

a. The Purchaser or Logistics Services Provider means the person, firm, company, organization or individual with whom the Contract is made.
b. The Supplier means the owner and publishers of www.FreightValuation.com
c. The Contract means the Contract between the Supplier and the Purchaser for the sale of a listing and/or advertising services, press release or other online services furthermore called "Services" of which these terms and conditions are part. All written and/or oral statements and representations are superseded by the Contract, unless inclusions or exclusions of terms contained herein are specifically varied by the Supplier in writing.

2. Acceptance of Services
a. The Purchaser by placing an order for the Service confirms their acceptance of the Contract and agrees to be bound by the Contract. Furthermore, regarding Press Releases the Purchaser accepts that the Editor's decision is final and the Supplier reserves the right to distribute Press Releases as they see fit.
b. Upon receipt of payment and information the Service will be made live.
c. The Supplier reserves the right to cease, suspend or remove Services from view, if at such time there is a dispute or delay over an agreed payment.
d. The Supplier reserves the right to suspend or remove Standard or Premium listings if they are not suitable or the purchaser is deemed to act in an unprofessional manner and unlawful act. The Supplier's decision is final.

3. Prices, Payments, Refund and Cancellation Policy
a. All prices quoted by the Supplier are exclusive of VAT/TVA and/or taxes applicable at the time except otherwise mentioned /published particularly.
b. All prices will be reviewed from time to time and any increase will be advertised within this website.
c. Payments will only be accepted in $US dollar Foreign Buyers and INR for Indian Buyers.
d. No Refund will be made by Supplier in any case. Supplier decision will be final if any payment issue raised by Purchaser.
e.  Refund if allowed by Supplier, shall be paid to the original credit card provided at the time payment made to Supplier.  In case of payment gateway name payments refund will be made to the same account.
f. No Cancellation shall be allowed in any case. Supplier decision will be final if any issue raised by Purchaser.

4. Copyright
a. The Supplier reserves copyright on all materials and designs and forbids the Purchaser to pass such materials and designs to a third party or associated business without first seeking the Suppliers        permission and agreement.
b. Any third party copyright materials used by the Supplier on behalf ofthe Purchaser cannot be used by the Purchaser without first seeking the third parties permission or agreement.
d. If the Purchaser supplies the Supplier with text, photography, artwork, animation, brochures, information or material of any kind, the Supplier will not at any time be responsible whatsoever in              regard to copyright, errors or omissions, faults or subsequent damages. This also includes that supplied by software, discs or electronic transfers if supplied by the Purchaser to the Supplier for            publishing to the Internet.
e. The Purchaser must indemnify the Supplier against third parties suffering subsequent faults and damages caused to hardware,software programs, or such damages as loss of production and
    earnings, due to materials supplied by the Purchaser for use by the Supplier.
f.  The Supplier will not be held responsible for establishing 'Rights of Usage' on any materials supplied by the Purchaser.

5. Confidentiality
a. The Supplier will use every endeavor to maintain confidentiality on information so received.

6. General
a. Failure or delay by the Supplier in enforcing any term of the Contract shall not be construed as a waiver of any of its rights under it.
b. The illegality, invalidity or unenforceability of any part of this Contract will not affect the legality,validity or enforceability of the remainder.
c. This Contract shall be construed in all aspects as a Contract and in conformity with Indian Law.
d. If Any change in Terms & Conditions, the new version will publish/update on FreightValuation.Com

FreightValuation.com does not do any kind of checking of legitimacy/validity of any subscriber or user. But we encourage all buyers to carry out their own due diligence before entering into a relationship with a third party supplier like you would with any business relationship that you enter.

We advise you to take care of the following simple steps to reduce the chance of fraud or theft of your goods or money. These include:

1. Check that the company is a legitimately registered in their trading country and if possible purchase copies of their trading accounts.

2. Write a contract that both parties agree to. Ensure that the contract covers all costs for the transit of the goods from destination to arrival.
    This is useful in case any party disagrees about a service. It can also be called upon if a legal dispute arises.

3. Where possible, avoid instant cash transfers via companies like Western Union / MoneyGram. Always leave a paper trail and make payments direct from your bank or credit card.

4. Search the internet for reviews or possible blacklisting. If they have done it before you will generally find out online with some simple searching around.

5. Check to see if they are members of any trade associations or freight networks and contact them to check their validity.

6. Check their trading address to make sure it is not run from a home. Check street maps to see if they have a business premises.



What should I do if I suspect fraud?

If you have exhausted every method to contact the supplier and feel that you are the victim of fraud, please write us about the same, we will try to contact the supplier to try to establish communication with you.

Unfortunately we are unable to get involved in the detail of the dispute as the contract is between you and the supplier.We would then advise that you contact the law enforcement agency in that state or country. You could also contact a legal professional in that country to see what rights you have in pursuing the supplier.Alternatively there are debt recovery agencies that will work on your behalf normally for a percentage of the recovered funds.Whilst the above list is not definitive we do advise that you carry out your own due diligence before entering into a contract with any third party.
